This Acceptable Use Policy is incorporated into the RelativityOS Terms of Service. Capitalized terms have the meanings given there. A breach of this Policy is a material breach of the Terms of Service.
Customer is responsible for every violation of this Policy occurring under its Account or through its credentials, and will not assist or encourage any person to violate it. The examples in this Policy are illustrative and are not exhaustive.
The Service transmits calls and messages through telecommunications providers and the mobile carriers. Their rules apply to Customer's traffic in addition to this Policy, change without notice to Tensyr, and are enforced against Customer's traffic whether or not this Policy has been updated to describe them. Registration of a messaging campaign is not approval of its content; the two are evaluated separately.
1. Consent
Customer will not use the Service to:
(a) send any call or message without the consent applicable law requires, including prior express written consent where a marketing message requires it;
(b) rely on consent obtained by another business, for another business, or for a different subject matter, or buy, sell, rent, share or otherwise transfer consent. Consent does not travel with a contact record, however the contact is described by its source;
(c) send to contacts that were purchased, rented, scraped, harvested, compiled from public sources, or otherwise acquired without consent given directly to Customer;
(d) send marketing messages where consent was captured only for transactional or informational messages, or where consent was bundled into a single action granting several permissions at once; or
(e) send messages on a subject matter materially different from the one for which consent was given.
At the point of opt-in, Customer will present the sender's identity, the type and frequency of messages, that message and data rates may apply, and how to stop. Customer will retain proof of each consent, including its source, date, time and the disclosure text presented, and will produce it within five business days of Tensyr's request.
2. Opt-out, help and sender identification
Customer will not use the Service to:
(a) fail to honor STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE or any reasonable equivalent, in any capitalization or spelling, however and through whatever channel the request is received;
(b) send any message after an opt-out other than a single confirmation;
(c) use non-standard opt-out phrasing, deliberate misspellings, images of text or any other technique that causes an opt-out request to go undetected, or make opting out conditional or more than a single step;
(d) re-import, re-acquire or re-subscribe a contact who has opted out;
(e) send a message that does not identify Customer as the sender, or use another party's brand, number or sender identity; or
(f) fail to respond to a request for help with Customer's identity and a means of contacting Customer.
3. Prohibited message content
Customer will not use the Service to send messages relating to, offering, promoting or linking to:
(a) phishing, smishing, social engineering, fraud, or impersonation of a government agency, carrier or financial institution, including simulated phishing conducted for security testing;
(b) controlled, regulated or restricted substances, including cannabis, CBD and prescription medication that cannot lawfully be sold over the counter, whether or not lawful in any particular jurisdiction;
(c) gambling, including sports betting, online casinos, lotteries and paid-entry sweepstakes;
(d) sexual or adult content;
(e) hate speech, or content promoting discrimination or violence against a person or group on the basis of a protected characteristic;
(f) high-risk financial services, including payday and short-term high-interest lending, loan solicitation by any party that is not the direct lender, debt consolidation, debt relief, credit repair, cryptocurrency promotion, and investment signals;
(g) third-party debt collection;
(h) get-rich-quick, work-from-home, multi-level marketing, pyramid or recruitment offers, and income or earnings claims of the kind those offers use;
(i) third-party lead generation or affiliate marketing, or any arrangement in which consumer contact information is collected for, shared with or sold to another party; or
(j) anything unlawful in any jurisdiction in which the recipient may be located.
Alcohol, tobacco, vaping, firearms, sweepstakes and contests are treated by the carriers as conditional rather than permitted. Customer will not send messaging in those categories through the Service without Tensyr's prior written approval and an age gate applied at opt-in.
4. Messaging practices
Customer will not:
(a) send from more telephone numbers than the function of its messaging requires, or distribute similar content across multiple numbers to raise throughput, dilute reputation metrics or avoid filtering;
(b) replace, rotate or acquire new numbers in response to a number being blocked or filtered;
(c) share a number across businesses or brands, or allow another party control over the content sent from a number provisioned to Customer;
(d) use public link shorteners, cycle domains across similar content, or use redirects to obscure a destination;
(e) send traffic that does not match the campaign, brand or use case registered with the carriers, or send on an unregistered number; or
(f) take any other action designed to evade carrier filtering, spam detection or number reputation systems.
Customer will register its brand and campaigns as the carriers require, will keep the registration consistent with the traffic actually sent, and will declare every attribute the carriers require.
5. Calling
Customer will not use the Service to:
(a) call or message outside the calling hours permitted in the recipient's jurisdiction;
(b) record any call without the consent required in the jurisdiction of every party to that call, obtained before recording begins;
(c) call any number on a national do-not-call registry where scrubbing is required, or on Customer's own do-not-call list; or
(d) make or seek emergency services. The Service is not capable of connecting to emergency services and Customer will not represent otherwise.
6. Prohibited content and conduct
Customer will not use the Service with content, or in a manner, that:
(a) is unlawful, fraudulent, deceptive or misleading;
(b) is defamatory, harassing, threatening, abusive, or invasive of privacy or of a right of publicity;
(c) infringes any patent, trademark, copyright, trade secret or other proprietary right;
(d) contains or links to malware, ransomware, spyware or other harmful code;
(e) exploits or endangers a minor, or targets a person known or reasonably believed to be under thirteen;
(f) promotes violence, terrorism, or discrimination against any person or group on the basis of a protected characteristic; or
(g) violates any law applicable to Customer, its Users, or the recipients of its communications.
7. Technical conduct
Customer will not:
(a) probe, scan or test the vulnerability of the Service or any system supporting it, or breach or circumvent any authentication, rate-limiting or security measure;
(b) access the Service other than through the interfaces Tensyr provides, including by scraping, spidering or crawling;
(c) impose a disproportionate load on the Service, or use automated means to issue requests at a rate exceeding what a person could produce through normal use;
(d) interfere with the integrity, performance or availability of the Service or any other customer's use of it;
(e) attempt to access any account or data Customer is not authorized to access; or
(f) take any action causing Tensyr's addresses, domains, numbers or sending identities to be blocked, filtered or reputation-damaged.
8. Artificial intelligence
Customer will not use the artificial intelligence features of the Service to:
(a) generate individualized advice that in the ordinary course of business would be provided by a licensed professional, including medical, financial, tax or legal advice;
(b) make or automate any determination that applicable law requires a person to make;
(c) send communications to consumers without human oversight of the configuration producing them;
(d) present output as human-generated where that would deceive the recipient, or fail to disclose that a person is interacting with an automated voice or chat agent where disclosure is required; or
(e) generate content prohibited by Section 3 or Section 6.
9. Restricted activities
Certain activities generate complaint rates, filtering and regulatory attention that affect Tensyr's ability to deliver the Service to its other customers. Tensyr may decline or discontinue service where the Service is used for them, whether or not any other provision of this Policy is breached. Examples include cryptocurrency and digital assets, gambling, payday and high-cost lending, debt relief and credit repair, multi-level marketing, affiliate marketing, list brokerage, lead resale, work-from-home and income-opportunity programs, escort and dating services, and the sale of social media engagement.
Tensyr may also evaluate and restrict any use of the Service in accordance with the policies and compliance standards of the telecommunications providers and carriers through which the Service transmits, as those change from time to time.
10. Enforcement
Tensyr has the right, but not the obligation, to monitor or investigate use of the Service for compliance with this Policy. Tensyr has no duty, unless applicable law provides otherwise, to prescreen, control, monitor or edit Customer Data or Customer's use of the Service, and no review Tensyr performs creates one.
Where Tensyr reasonably believes this Policy has been violated, whether within or outside Customer's use of the Service, Tensyr may, with or without prior notice and without liability to Customer: remove or disable the content or configuration concerned; suspend or terminate the access of any individual User; suspend messaging or calling; throttle or rate-limit activity; suspend the Account; or terminate the Terms of Service in accordance with their terms. Tensyr may also act where Customer fails to respond within a reasonable period after Tensyr has contacted Customer about a potential violation.
Tensyr will suspend or terminate Customer's access to calling and messaging where a telecommunications provider or carrier instructs Tensyr to do so, or where Tensyr receives repeated complaints from recipients or from such a provider. Suspension does not excuse payment.
Customer is solely responsible for all fines, fees, filtering, suspensions and pass-through charges assessed by any carrier or telecommunications provider in connection with Customer's traffic, and for any assessment made against Tensyr on account of that traffic.
Tensyr may report activity it suspects violates applicable law to law enforcement or regulators, and may disclose the information reasonably necessary to do so.
11. Reporting
Customer will notify Tensyr promptly on becoming aware of any violation of this Policy and will provide the assistance Tensyr reasonably requests to stop or remedy it. Suspected violations may be reported to legal@tensyr.com.
12. Updates
Tensyr may update this Policy on notice, in accordance with Section 16.2 of the Terms of Service. Where an update reflects a change in the rules of a carrier or telecommunications provider, those rules apply to Customer's traffic from the date they take effect, whether or not this Policy has yet been updated to describe them. The date above reflects the most recent update, and prior versions remain available in the archive.
